Although the Eighth Amendment of the U.S. Constitution clearly prohibits unusual and barbarous penalization, the United States Supreme Court in the 1947 case of atomic number 57 ex rel. Frances v. The arguments for and against the death penalty are strong on both sides, but the capital punishment sh ould not be constitutional in such a civilized and democratic country as it is the United States of America.There are many people who see the final punishment as essential castigation of those who do not set a human life. Nevertheless, there is a risk of executing an unprejudiced person. A case of Cameron Todd Willingham may be just one example. He was convicted to the capital punishment for setting a call down and thus violent death his three small children.
